19-1. Medical Examination
When an employee’s possible medical and/or psychological condition is in question as it relates to his/her position with the Village, the Village Manager may require that employee to take a medical, drug and/or psychological examination at the expense of the Village. The reason for such examination may include, but is not limited to:
when an employee’s work performance or record of attendance declines.
when an employee seeks an accommodation for a disability in order to determine the need and type of accommodation.
determining if an employee returning from a workers’ compensation or medical leave can perform the duties of his/her job.
monitoring the employee as required by applicable laws or policies, such as under the Drug Free Workplace Policy.
Based on an employees behavior or interaction with other employees.
The examination shall be coordinated through the Human Resources Department. The Village’s physician, designated by the Village Manager and at the expense of the Village, will be responsible for determining the medical and/or psychological fitness of the employee. Should the Village physician determine that an employee is unable to perform his/her job, such employee may, within five (5) days of receiving such notification, indicate in writing, to the Village Manager, his/her intention of submitting the determination by the Village physician to his/her own physician. Should the opinions of the Village physician and the employee’s physician differ, a third physician shall be mutually selected by the Village physician and the employee’s physician who will render a final decision regarding the employee’s
ability to perform his/her job. Should this third physician find the employee unable to perform his/her job, he/she may be discharged upon notice from the Village Manager.
Any job offer extended to an applicant is conditioned upon the successful completion of a pre-employment physical and drug screening test, at the expense of the Village, in order to determine the applicant’s fitness to perform the functions of the job for which he/she has applied.
